At 5:15 p.m. on August 30, 1862, the Second Brigade of Ricketts' Second Division, Third Corps, Army of Virginia, commanded by Brig. Gen. Zealous B. Tower and including the 26th New York, 88th Pennsylvania, 94th New York, and 90th Pennsylvania, rushed forward on the double quick and deployed as best it could facing the enemy near the Chinn House. According to John Vautier of the 88th Pennsylvania Infantry, the Confederates soon advanced in many lines of battle, and the brigade opened fire and checked their advance, but the infantry fire was so destructive that the men could not effectively return it or get the companies into order to successfully resist the Rebel advance.
